Terms of Use

1. Scope

These General Terms and Conditions govern the use of the "before" app and the associated website (app.before.social), operated by Thomas Gnahm, Mainzer Str. 44, 12053 Berlin (hereinafter "operator" or "we"). By registering, users accept these terms of use.

2. Description of the Service

"before" is a dating app that brings people together through real-world events. Users attend events, check in on site using a QR code, and can then discover and match with other attendees. The service is currently in its beta phase and is free to use.

3. Registration and User Account

• Minimum age: Use of "before" is only permitted from the age of 18.
• Truthful information: Users are required to provide truthful information when registering.
• One account per person: Each person may create only one user account.
• Login credentials: Users are responsible for keeping their login credentials secure.
• Account verification: We reserve the right to verify accounts and deactivate them in the event of violations of these terms of use.

4. Rules of Conduct

Users agree to treat one another respectfully. In particular, the following is prohibited:

• Harassment, threats, hate speech, and discrimination of any kind
• Creating fake profiles, identity theft, commercial advertising, and spam
• Uploading illegal, violent, or pornographic content
• Attempts to contact users outside the app against their will

Violations may result in temporary or permanent suspension of the account.

5. Content and Rights

• Ownership: Users retain ownership of their uploaded content (photos, texts).
• License: By uploading content, users grant "before" a non-exclusive, worldwide, royalty-free license to display, store, and process the content for the purpose of providing the service.
• End of license: This license ends when the content is deleted or the account is removed.
• Responsibility: Users are solely responsible for ensuring that they hold the necessary rights to uploaded content.
• Removal: "before" reserves the right to remove content that violates these terms of use.

6. Data Protection

For details on the processing of personal data, please refer to our Privacy Policy.

Notice pursuant to Art. 9 GDPR: The app processes special categories of personal data (sexual orientation). This requires explicit consent, which is obtained during registration.

7. Availability of the Service

• We strive for high availability of the service but do not guarantee uninterrupted operation.
• Maintenance windows and updates may result in temporary unavailability.
• We reserve the right to modify or discontinue features.

8. Liability

• "before" is not liable for user-generated content.
• "before" does not guarantee the accuracy of profile information.
• "before" is not responsible for users' conduct at events or in their private lives.
• Liability is limited to cases of intent and gross negligence, to the extent permitted under German law.
• This limitation of liability does not apply to damage arising from injury to life, body, or health, or to mandatory liability under the German Product Liability Act.

9. Termination and Deletion

• Users can delete their account at any time through the app settings.
• We may terminate or suspend accounts that violate these terms of use, with prior notice where possible.
• After account deletion, personal data will be deleted in accordance with our Privacy Policy (30-day revocation period).

10. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final Provisions

• The law of the Federal Republic of Germany applies.
• If individual provisions of these terms of use are or become invalid, the validity of the remaining provisions remains unaffected (severability clause).
• The place of jurisdiction for merchants is Berlin.
